Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Marzical ("Company," "we," "us," or "our") concerning your access to and use of the Telepromptus application and related services (collectively, the "Service").
By accessing or using our Service on iOS, Android, or Web, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
Description of Service
Telepromptus is an all-in-one teleprompter application designed for content creators, combining camera, teleprompter, and controller into a single unified experience. The Service enables users to:
- Create, edit, and manage scripts for video production
- Display scrolling text while recording video
- Record video directly within the application
- Control camera, teleprompter, and recording from one interface
- Sync scripts across multiple devices
- Access the service via iOS, Android, or Web
User Accounts
Account Creation
To access certain features of the Service, including web sign-in and cross-device sync, you must create an account. You agree to provide accurate, current, and complete information during registration.
Account Security
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
Important: You are solely responsible for all activity that occurs under your account, whether or not you authorized that activity.
Subscription and Payments
Free Features
Telepromptus offers certain features free of charge. We reserve the right to modify which features are available for free at any time.
Premium Features
By subscribing to Telepromptus Premium or any paid plan, you agree to pay all fees associated with your chosen plan. Subscription fees are billed through the App Store, Google Play, or our web platform.
Refunds
Refunds for purchases made through the App Store or Google Play are subject to their respective refund policies.
User Content
Ownership
You retain all rights to the content you create, upload, or record using the Service ("User Content"), including scripts, videos, and audio recordings. We do not claim ownership of your User Content.
License to Marzical
By using the Service, you grant us a limited, non-exclusive license to process your User Content solely for the purpose of providing and improving the Service.
Content Responsibility
You are solely responsible for your User Content. You represent and warrant that:
- You own or have the necessary rights to use your User Content
- Your User Content does not violate the rights of any third party
- Your User Content complies with all applicable laws
Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon the intellectual property rights of others
- Distribute malware, viruses, or other harmful code
- Harass, abuse, or harm another person
- Attempt to gain unauthorized access to the Service
- Interfere with or disrupt the Service
- Reverse engineer the Service
We reserve the right to suspend or terminate your account if you violate these Terms.
Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are the exclusive property of Marzical. The Telepromptus name, logo, and all related marks are trademarks of Marzical.
Third-Party Services
The Service may integrate with third-party services, including:
- Cloud storage providers (Google Drive, Dropbox, iCloud)
- App Store and Google Play
- Authentication providers (Google Sign-In)
We are not responsible for the content or practices of third-party services.
Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We do not warrant that the Service will be uninterrupted, secure, or error-free.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARZICAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so through the app settings or by contacting us.
Changes to Terms
We reserve the right to modify these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to new terms taking effect.
